Welcome to Breakout Media, LLC/InmateFriend (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our automated phone-based information service, website, and any related products or features (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service
Company provides a prepaid, usage-based automated information service. Customers may call a designated phone number to access:
An automated personal assistant
AI-generated responses
Educational and informational audio content
We do not provide telecommunications carrier services, third-party calling services, call routing, or any form of communication between outside parties. The Service provides information and audio content only.

2. Eligibility
You must be legally able to enter into a binding contract to use the Service. By using the Service, you confirm that:
You are authorized to use the payment method you provide
You will use the Service in compliance with all applicable laws and facility rules
You will not misuse or interfere with the Service’s operation

3. Use of Prepaid Minutes
The Service is purchased on a prepaid, per-minute basis. When you make a purchase:
Minutes are added to your account immediately
Minutes are deducted based on your actual usage
Unused minutes do not expire unless required by law
All purchases of prepaid minutes are final, as detailed in our Refund Policy.

4. Account Responsibility
You are responsible for:
Maintaining the security of your account
Ensuring accurate phone access
Using the Service only as permitted by these Terms
The Company is not responsible for:
Phone carrier issues
Facility restrictions
Blocked calls
Interruptions caused by third-party systems outside our control

5. Prohibited Uses
You agree not to use the Service for:
Illegal activities
Attempting to access systems you are not authorized to use
Harassing or abusive behavior
Reselling or redistributing the Service
Attempting to bypass usage charges or tamper with the system
Trying to use the Service to place calls or contact third parties
Violations may result in immediate suspension or termination of your account.

6. Billing and Payments
All payments are processed securely through third-party payment providers. By purchasing minutes, you authorize us and our payment partners to charge your selected payment method. You agree to provide accurate billing information and update it as needed.

7. Refund Policy
All purchases of prepaid minutes are non-refundable, except in cases of verifiable system error. Full details are available in our Refund Policy.

8. Service Availability
We make reasonable efforts to maintain reliable access to the Service, but:
We do not guarantee uninterrupted availability
We may perform updates or maintenance
We may restrict access to prevent abuse or comply with legal requirements
We are not liable for outages or service interruptions.

9. AI-Generated Content Disclaimer
The Service may provide AI-generated information, responses, or audio content. You acknowledge that:
AI responses may not always be accurate
The content is for informational purposes only
The Service does not provide professional, legal, medical, or financial advice
You use the Service at your own discretion.

10. Limitation of Liability
To the maximum extent permitted by law:
The Company is not liable for indirect, incidental, or consequential damages
Our total liability for any claim will not exceed the amount you paid for minutes in the past 30 days
You agree to hold us harmless from claims arising from misuse of the Service

11. Termination
We may suspend or terminate your access to the Service if:
You violate these Terms
You engage in fraudulent or abusive behavior
Required by law or by facility policy
Technical or security issues arise
Unused minutes are not refunded upon termination.

12. Changes to These Terms
We may update these Terms at any time. Updates will be posted on our website with a new “Last Updated” date. Continued use of the Service after changes means you accept the revised Terms.
